摘要
在刑事领域,国家安全法治主要体现为对安全、自由二元基本价值的追求,并将其贯穿于刑事法律制定和实施过程中,以期实现特定的国家安全法治目标和法治效果。针对基本价值在动态运行中产生的冲突和矛盾,要在国家安全法治"实然状态的基础上,借鉴"帕累托最优"构建平衡制度和最优化运行路径:从整体上把握基本价值的角色和作用;提升治理场景和治理场域的精细度;建立冲突协调机制,在实现好"次优理论"下的相对安全和相对自由的同时,在犯罪预防上追求国家安全的相对优位性、在权利救济上强调个人自由保障的相对优位性,用最小的法治成本实现最大的法治效果,推动实现国家安全法治体系和法治能力现代化的"应然状态"。
In the field of criminal law,the rule of law in national security is primarily manifested in the pursuit of two basic values of security and freedom.The two basic values run through the formulation and implementation of criminal law to achieve the goal and effect of rule of law in national security.To address the conflict resulting from the dynamic operation of the two basic values,it is imperative to construct a balanced system and an optimal operating path by drawing upon the"Pareto Optimality"on the basis of the"actual state"of the rule of law in national security.To this end,the following measures should be taken:viewing the roles and functions of the two basic values in a comprehensive manner;improving the scenarios and fields of governance;establishing conflict coordination mechanisms,pursuing the relative priority of national security in crime prevention and emphasizing the relative priority of individual freedom protection in right relief while ensuring the relative security and relative freedom of the"Theory of the Second Best"to maximize effect of rule of law with the minimum cost and facilitate the"ideal state"of the modernization of the system and capacity of rule of law in national security.
