摘要
迄今为止,国际裁判只在十分有限的情况下影响了对大陆架界限委员会的工作,原因是大陆架界限委员会对与外大陆架定界案有关的国际裁判采取了依赖争端当事方立场的处理方式。这种做法符合该机构的《议事规则》及其法律性质。由此,就大陆架界限委员会的审议实践而言,打破因争端当事方的反对而无法审议定界案僵局的希望,在于争端当事方而非国际法庭。借助国际法庭的裁判打破委员会审议僵局的设想,很可能难以实现。孟加拉国定界案的处境就是其中一个生动的实践案例。
So far the international decisions have influenced the work of the Commission on the Limits of the Continental Shelf(CLCS) only in very limited circumstances.This is because the CLCS relies on the positions of the parties to the dispute when treating the international decisions involved in the submissions concerning the outer continental shelf.The approach accords with the Rules of the Procedure of the CLCS as well as the nature of the body.Consequently,the wish to break the deadlock that the CLCS cannot consider a submission because of the objection of the party to a dispute should be put on the parties to the dispute rather than the international tribunals.It might be very hard to realize the idea that the deadlock in the CLCS can be broken by resorting to the decisions of international decisions.The Submission by Bangladesh provides a good example in this regard.
