论教育法典的功能定位、体例结构和编纂步骤 被引量:22

On the Functional Position,System Structure and Compilation Steps of the Education Code

摘要 我国教育法典的编纂已经提上日程。编纂教育法典首先需要厘清它的功能定位、体例结构,进而确定其编纂步骤。在功能定位上,我国的教育法尚不构成独立部门法,可以划入领域法的范畴;同时,教育法典应兼具管理法和救济法的功能。在体例结构上,教育法典应当是法典编纂而非法律汇编,可以采取总则加分则的模式。此外,在编纂过程中还需要关注教育法典与宪法、行政法、民法、知识产权法、刑法以及现行教育领域的法律法规之间的配合与协调。教育法典的编纂首先需要做好充分的理论研究准备,其次需要对当前的教育法律体系进行补充、修订、清理和体系化,最后再分步编纂总则与分则。 The codification of the Education Code in China is on the agenda.To compile the Education Code,it is necessary to clarify its function position,system structure,and then determine its compilation steps.In terms of function,the education laws of our country haven’t constituted an independent sector law yet,but can be divided into the category of field law.At the same time,the Education Code has the functions of both a regulatory law and a remedial law.In terms of system structure,the Education Code should be a codification rather than a compilation of laws,and it can adopt a General Principles and the subdivisions model.In addition,it is also necessary to pay attention to the cooperation and coordination between the Education Code and the Constitution,Administrative Law,Civil Law,Intellectual Property Law,Criminal Law and the current education laws and regulations.The codification of the Education Code requires adequate preparation of theoretical research.And after the supplement,revision,cleaning and systematization of the current education legal system,the codification of the General Principles and the subdivisions can be accomplished step by step.
