摘要
法定犯的违法性认识在司法实务中存在不予审查、审查不力两项问题。明确了违法性认识应属责任阶层的要素后,违法性认识的内容应是“前置法中影响罪名成立的全部法规范”。其中,事实型违法性认识错误中应认识到事实要素具有与法律禁止的要素相同的特征;法律型违法性认识错误中,明显违背社会公德的法定犯应认识到行为的法益侵害性,没有违背社会公德的法定犯应认识到违反了现实的法秩序。判定违法性认识应使用“违法性认识错误可避免性”为标准,一般主体和特殊主体,分别使用“一般人平行评价”与“同行业平行评价”准则,同时兼顾主观认知能力和客观认知环境进行综合判断。
In judicial practice,there are two problems in the understanding of the illegality of statutory offense:not to be examined and not to be examined effectively.After defining the elements that the cognition of illegality should belong to the responsible class,the content of the cognition of illegality should be"all the legal norms affecting the conviction of a crime in the prepositional law".Among them,we should recognize that the factual elements have the same characteristics as those prohibited by law;In the wrong understanding of legal illegality,the legal offenders who obviously violate social morality should be aware of the infringement of legal interests,while the legal offenders who do not violate social morality should be aware of the violation of the actual legal order.The judgment of illegality cognition should use"the avoidance of illegality cognition error"as the standard.The general subject and the special subject should use the"parallel evaluation of ordinary people"and"parallel evaluation of the same industry"respectively,and take into account the subjective cognitive ability and the objective cognitive environment for comprehensive judgment.
