摘要
司法鉴定作为查明案件事实的专门性活动,公信力关系到鉴定意见的质量。司法鉴定公信力困境主要存在于当事人对鉴定意见不信服、法官对鉴定程序过度依赖、舆论存在偏向性评价等方面。之所以存在这些困境,根源就在于当事人的认知、鉴定制度自身的缺陷、法官行为的失范、鉴定意见评价标准不统一等方面。基于此,提升我国司法鉴定公信力,应完善司法鉴定制度、规范法官行为、建立鉴定意见统一评价机制及完善专家证人出庭作证制度。
As a specialized activity to ascertain the facts of a case,judicial appraisal has a bearing on the quality of appraisal opinions.There exist some dilemmas at present,for instance,the litigants are not convinced by the appraisal opinions,the judges are excessively reliant on the appraisal procedures,or there are biased evaluation of public opinions.The root lies in the litigants’cognition,the defects of the appraisal system itself,the misconduct of judges,and the inconsistent evaluation standards of appraisal opinions,based on which,it is necessary to enhance the credibility of China’s judicial appraisal by improving the judicial appraisal system,standardizing the judges’behaviors,establishing a unified evaluation mechanism for appraisal opinions,and improving the system for expert witnesses to appear in court.
