摘要
目前我国城市户外广告设置存在不当设置、管理方式不合理等诸多问题,都市法在传统行政法的基础上为城市户外广告管理模式建构提供了新视角。户外广告设置管理现行制度大致分四种情况,即央地立法分权、区分大小、区分管理主体、区分广告与招牌,存在模式选择不区分户外广告类型、缺乏模式选择标准等问题。都市法要求户外广告设置管理模式应考虑央地立法权限划分、公共利益与个人利益、政府管理的经济成本、公民景观权利保护等因素。在现行制度的基础上,区分经济发达地区与经济欠发达地区以及商业广告和公益广告,针对户外广告占用公共空间资源与设置地点的不同,有针对性地选择许可、备案、自主管理等模式。
At present, there are many problems in urban outdoor advertising setting, unreasonable management mode and so on. The urban law has provided a new perspective for urban outdoor advertising management mode construction on the basis of the traditional administrative law. The current system of outdoor advertising setting management can be roughly divided into four situations, namely, the decentralization of central legislation, the division of size, the division of management subject, the division of advertising and signboards, there are problems such as mode selection does not distinguish the type of outdoor advertising, lack of model selection standards. The urban law requires that the management mode of outdoor advertising should consider such factors as the division of central and local legislative authority,public interests and personal interests, the economic cost of government management, and the protection of citizens’ landscape rights. On the basis of the current system, we distinguish the economically developed areas from the economically underdeveloped areas, commercial advertising and public service advertising,and select the permission, record, independent management and other modes according to the difference of outdoor advertising occupying public space resources and setting location.
