摘要
算法权力是平台金融权力的内核,平台金融监管应以算法权力监管为挈领。平台金融算法权力的弥散性、隐蔽性、非均衡性特征对传统监管构成严峻挑战,多元监管成为弥合监管信息鸿沟的重要工具,元规制、自我规制等算法监管理论皆滥觞于此。提高金融效率的最佳选择是改变金融制度结构,而法律是金融制度的内生因素,我国《个人信息保护法》以内部监管者与“独立监管者”之规定奠定了合作治理的制度基础,为创新算法监管设定了架构,应吸收以上规定构建以“独立监管者”为中心的平台金融元规制路径:辨析元规制与自我规制以锚定“独立监管者”之体系定位;解构平台金融算法权力以证成元规制之必要性;援引规范空间理论以明确元规制之指向性;依托整体制度观以实现元规制之目的性与问责性;借助监管沙盒赋予元规制以试错空间,以完善其规制实现。
Algorithmic power is the core of platform financial power,and platform financial supervision should focus on algorithmic power supervision.The diffuse,invisible,and non-equilibrium characteristics of platform financial algorithmic power pose serious challenges to traditional supervision.Thus,multiple supervision has become an important tool to bridge the regulatory information gap and algorithmic supervision theories such as meta-regulation and self-regulation all derive from the idea of multiple supervision.The best choice to improve financial efficiency is to change the structure of the financial system.Since the law is an endogenous factor of the financial system,the Personal Information Protection Law has established the institutional foundation for cooperative governance with the provisions of internal regulators and“independent regulators”,which sets framework for innovative algorithmic regulation.A meta-regulation path for platform finance centered on“independent regulators”should be constructed based on the above provisions:elaborating on meta-regulation and self-regulation to anchor the system positioning of“independent regulators”;deconstructing the power of platform financial algorithms to demonstrate the necessity of meta-regulation;invoking the theory of normative space to clarify the directionality of meta-regulation;relying on the overall system view to achieve the purpose and accountability of meta-regulation;making using of the regulatory sandbox to give meta-regulation room for trial and error to expand its practice path.
