摘要
大数据侦查是大数据时代纵深发展下的新型侦查措施,具有创新性、高度技术性和绝对秘密性,成为公安机关侦破案件的技术新宠儿。但是大数据侦查的绝对秘密性对数据利用公开原则下要求明确告知处理目的、处理范围和处理方式带来了冲突和挑战,对公民知情权和数据权的行使构成一定的障碍。为有效破除大数据侦查秘密性与数据公开利用之间的矛盾,本文引用公共利益目的正当化和数据真实准确性进行调和,以更好平衡“权力与权利”。
Big data investigation is a new investigation measure under the in-depth development of the big data era.It is innovative,highly technical and absolutely secret,and has become the new favorite of the public security organs in case detection.However,the absolute secrecy of big data investigation has brought conflicts and challenges to the requirement of making clear the purpose,scope and method of processing under the principle of open data utilization,and has posed certain obstacles to the exercise of citizens’right to know and data rights.In order to effectively eliminate the contradiction between the secrecy of big data investigation and the public use of data,this paper uses the justification of public interest purposes and the authenticity and accuracy of data to reconcile,so as to better balance“power and rights”.
