摘要
贯彻和践行积极老龄化理念,是系统推进积极应对人口老龄化国家战略的重要依托。我国已逐步形成以健康老龄化、生产性老龄化、智慧老龄化为基本维度的积极老龄化政策框架,具体政策的落实有赖法治充分发挥其引领、促进和保障作用。健康老龄化的实现,需要通过法律制度保障老年人的健康权,也需要借助法治手段提升老年人的内在能力,营造老年友好型社会环境。生产性老龄化的推进,需要以法治方式助推社会观念的革新,通过法治激励引领社会各方的行动计划、协助调配社会资源,通过法治权衡调处老年人群体与其他社会群体间的利益关系。智慧老龄化旨在通过“赋能”与“促权”为健康老龄化和生产性老龄化提供保障。在智慧老龄化的发展过程中,有待立法引导科技向善、消除数字鸿沟,保障老年人的个人信息权、隐私权等不受侵犯。
Implementing the idea of active ageing is an important basis for systematically promoting the national strategy of proactive response to population ageing.China has gradually developed a framework of active ageing policy with the healthy ageing,the productive ageing and the smart ageing as its basic dimensions.The implementation of concrete policies depends on the leading,promoting and guaranteeing roles of the rule of law.To realize the healthy ageing,it is necessary to guarantee the right to health of the elderly,enhance their intrinsic capacity and create an age-friendly environment by means of the rule of law.The advancement of the productive ageing requires the government to rely on the rule of law methods to promote the transformation of social attitudes,encourage and lead various stakeholders to adopt and implement relevant action plans,coordinate them in the allocation of social resources,and adjust the interest relationships among social groups of different ages.The smart ageing,which aims to ensure healthy and productive ageing through capacity-building and empowerment,requires the state to adopt legislation to guide the development of technology for social good,bridge the digital divide,and protect the right to personal information and the right to privacy of the elderly.
