摘要
药品专利链接制度是基于医疗产业的可持续发展和人民生命安全考虑而建立的。本文通过对药品专利链接制度的阐述,分析药品专利链接制度中利益平衡的必要性,进而设计出基于利益平衡对药品专利链接制度的合理限制。建立药品专利链接制度,还处在制度建立的初始阶段,有关该系统的条款和有关细则均需要细化和完善。
The drug patent linkage system is based on the sustainable development of the medical industry and the consideration of people's life safety.Through the elaboration of the drug patent link system,this paper analyzes the necessity of the balance of interests in the drug patent link system,and then designs a reasonable restriction on the drug patent link system based on the balance of interests.The establishment of the drug patent link system is still at the initial stage of the establishment of the system,and the provisions and relevant rules of the system need to be refined and improved.
