摘要
遵循《国际残奥委员会反兴奋剂条例》的最新发展(2021版),我国如何作出高质量应对是现阶段中国残疾人体育反兴奋剂斗争亟待关注与解决的重要议题。修订后的2021版《国际残奥委员会反兴奋剂条例》突出体现国际残疾人竞技体育反兴奋剂制度优化与革新的新态势,主要表现在着重强调残障运动员身心健康与权益保障;革新反兴奋剂防治手段;完善违反兴奋剂行为规范认定;优化赛事兴奋剂违规行为惩处机制;理清反兴奋剂部门内部权责,加强残疾人兴奋剂治理部门间“三位一体”协同。我国残疾人体育反兴奋剂相关部门应内化其条例宗旨,依据其最新发展对我国残疾人体育反兴奋剂法律法规进行相应的修订和补充,充分发挥反兴奋剂组织的作用,优化残疾人体育组织架构与职能,加强国际互动与协作,促进与国际残奥委会反兴奋剂治理体系的顺畅衔接,达成构建和谐共生的纯洁体育环境愿景。
Following the latest development of the “International Paralympic Committee Anti-Doping Regulations”(2021 edition), how to make a high-quality response in China is an important issue that needs to be paid attention to and resolved at this stage in the fight against sports anti-doping for the disabled in China. It is found that the revised 2021 edition of the International Paralympic Committee Anti-Doping Regulations highlights the new trend of optimization and innovation of the anti-doping system in international disabled competitive sports, mainly in the emphasis on the physical and mental health and rights protection of disabled athletes;the regulation innovates anti-doping prevention and control methods, improve the identification of violations of the doping code of conduct, optimize the punishment mechanism for doping violations in competitions, clarify the inner rights and duties of the anti-doping departments, strengthen the coordination among the anti-doping departments for the disabled. The relevant departments of sports anti-doping for the disabled in China should internalize the purpose of their regulations, revise and supplement the laws and regulations on sports anti-doping for the disabled in China according to their latest developments, give full play to the role of anti-doping organizations, and optimize sports for disabled people, improve the organizational structure and functions, strengthen international interaction and collaboration, promote smooth connection with the anti-doping governance system of the International Paralympic Committee, and achieve the vision of building a pure sports environment of harmonious coexistence.
