摘要
监察制度改革导致检察机关职权发生了重大变化,理论界因此对人民监督员制度出现了“存废之争”。在新时代背景下,人民监督员制度仍然具有重要的民主价值、伦理价值、实践价值与时代价值。深度贯彻与融合全过程人民民主,应当是人民监督员制度发展的重要趋向,也是司法民主制度创新的重要思路。从实践探索来看,我国人民监督员制度宜在人民监督员选任机制、人民监督员监督方式、人民监督员监督实效保障机制等方面进一步创新。
The reform of supervision system has led to major changes in the powers of the procuratorial organizations. Scholars have had a debate on "preservation or abolition" of the people’s supervisor system, which,however, is still of important democratic value, ethical value, practical value and era value in the context of new era. Deeply implementing and integrating people’s democracy in the whole process should be an important trend in the development of the people’s supervisor system and also an important idea for the innovation of the judicial democracy system. From the perspective of practical exploration, the system of people’s supervisors should be further innovated in terms of the selection and appointment mechanism of people’s supervisors, the supervision methods of people’s supervisors, and the guarantee mechanism for the effectiveness of people’s supervisors’ supervision.
