摘要
近年来全球性气候挑战日益严峻,节能减排成为人类活动的一大主题,碳汇项目应运而生。林业碳汇交易在国际碳市场上占有重要地位且发展较快,但我国林业碳汇交易在缺乏法律保障的情况下呈现出森林碳汇权属不明、监管主体复杂且职能交叉、碳汇合同诈骗等一系列问题。为了保障林业碳汇项目的长远发展,早日实现碳达峰和碳中和目标,提出制定专门的法律法规,明确森林碳汇权属,完善森林碳汇计量监测体系,建立统一的监管平台、完善信息公开制度、明确法律责任等林业碳汇交易法律制度的完善路径。
In recent years,the global climate challenge has become increasingly severe.Energy conservation and emission reduction has become a major theme of human activities,and carbon sinks projects came into being.Forest carbon sinks trading plays an important role in the international carbon market and develops rapidly.However,in the absence of legal protection,China′s forest carbon sinks trading presents a series of problems such as unclear ownership of forest carbon sinks,complex and overlapping functions of supervision subjects,and carbon sinks contract fraud.In order to ensure the long-term development of forestry carbon sinks projects and achieve carbon peak and carbon neutralization as soon as possible,this paper put forward a perfect path to formulate special laws and regulations,clarify the ownership of forest carbon sequestration,improve the forest carbon sinks measurement and monitoring system,establish a unified supervision platform,improve the information disclosure system and clarify legal responsibilities.
