摘要
基于碳达峰、碳中和目标与现代环境治理体系在科学与政策层面的客观耦合关系,纳入“双碳”目标的现代环境治理体系是新时代绿色发展观和生态文明建设的必然结果,亦是实现气候效益与生态环境效益统一的现实需要。借鉴和运用元治理理论,能够为二者的协同提供理论支撑和实践思路。现行环境治理体系总体呈现“良法”不一、“善治”不足的运行局面,亟待从涉碳价值认知、涉碳事权配置、涉碳制度供给、涉碳风险防控等层面进行协同规制。“双碳”转型与现代环境治理体系的协同逻辑,可归纳为规范整合的目标协同、公私互动的权益协同、区际府际事权配置的执法协同、司法适度能动的救济协同四个维度。为回应二者协同化的法治需求,应着重从环境影响评价制度、环境风险防控机制、环境信息公开制度、环境绩效考评问责机制、绿色低碳消费促进制度进行对标重塑,以彰显现代环境治理体系的法治之道。
Based on the objective coupling relationship between carbon peak,carbon neutral target and modern environmental governance system at the scientific and policy levels, the modern environmental governance system integrated into the“double carbon”target is the inevitable result of the green development concept and the construction of ecological civilization in the new era,and also the practical need to achieve the unification of climate benefits and ecological environmental benefits. The reference and application of meta-governance theory can provide theoretical support and practical ideas for the coordination of the two. The current environmental governance system is generally characterized by“good law”and“good governance”. It is urgent to carry out coordinated regulation from the aspects of carbon-related value recognition,allocation of carbon-related rights,supply of carbon-related institutions,and prevention and control of carbon-related risks.The coordination logic between the“double carbon”transformation and the modern environmental governance system can be summarized into four dimensions:the goal coordination of normative integration,the rights and interests coordination of public-private interaction, the law enforcement coordination of interregional intergovernmental power allocation,and the moderately active judicial relief coordination. In order to respond to the demand for the rule of law of the synergy of the two,we should focus on the benchmarking and remodeling of the environmental impact assessment system,the environmental risk prevention and control mechanism,the environmental information disclosure system, the environmental performance evaluation and accountability mechanism,and the green and low-carbon consumption promotion system,in order to highlight the rule of law of the modern environmental governance system.
