摘要
外卖行业主体利益平衡状态事关骑手权益保障水平与行业发展前景,算法技术逐渐异化平台用工,平台与骑手间的利益失衡问题愈发显著,骑手权益保护面临诸多困境。在法律层面,平台用工关系的定性不明确,法律程序对骑手用工纠纷缺乏现实关切,事后保障措施难以落到实处;在行业层面,平台资源配置不均与自身调解功能的局限性使骑手保障内外交困。对此,应提高法律对外卖行业的规制,设立骑手权益保障前置制度,加强智能法律监管融入平台算法当中,同时灵活调整从属性标准包容行业特性,并且在法律保障上设立跨平台联合工伤保险基金,立足行业实际制定真正普惠全体骑手的权益保障制度。
The balance of interests of the main body in the takeaway industry is related to the protection level of the rights and interests of the riders and the development prospects of the industry.The algorithm technology gradually alienates the platform employment,and the imbalance of interests between the platform and the riders is becoming more and more significant,and the protection of the rights and interests of the riders is faced with many difficulties.At the legal level,the qualitative nature of the platform employment relationship is not clear;the legal procedure lacks practical concerns for rider employment disputes,and the post-event safeguard measures are difficult to be implemented.At the industry level,the uneven allocation of platform resources and the limitations of its own mediation function make rider protection internally and externally difficult.In this regard,it is necessary to improve the legal regulation of the takeaway industry,establish a pre-protection system for the rights and interests of riders,strengthen intelligent legal supervision into the platform algorithm,flexibly adjust the subordination standard to include the characteristics of the industry,set up a cross-platform joint work-related injury insurance fund in legal protection,and formulate a truly inclusive rights and interests protection system for riders based on the actual situation of the industry.
