摘要
党的二十大报告提出“创新是第一动力”,要“深入实施科教兴国战略、人才强国战略、创新驱动发展战略,开辟发展新领域新赛道,不断塑造发展新动能新优势”。专利是连接创新与发展之间的重要纽带。专利开源作为一种新兴的专利运用方式正吸引越来越多业界人士关注。专利开源在理念上与传统的专利运用方式有较大差别,应根据专利开源的理念与实践进一步梳理其内涵与模式。通过与传统专利运用方式的对比发现专利开源的优势与劣势,明确专利开源的风险,寻找在产业中运用专利开源的机会。为进一步指导专利开源的实践,应从企业、行业与国家三个层面提出专利开源战略,制定相应的风险防控措施,以充分发挥专利开源在营造专利生态方面的优势,促进国内相关产业的快速发展。
The Report of the 20th CPC National Congress pointed out that"innovation is the frst driving force".It is necessary to further implement the"innovation-driven development strategy,open up new areas and new arenas in development and steadily foster new growth drivers and new strengths".Patent is an important link between innovation and development.As an emerging method for patent application,patent open source is attracting more attention in the industry.However,due to the large difference between the concepts of this method and the traditional methods for patent application,there are many concerns when applying.It requires further combing its connotation and mode according to the concept and practice of patent open source,discovering its advantages and disadvantages by comparing with traditional patent application,clarifying its risks,and finding opportunities to use it in the industry.In order to provide further guide to the practice of patent open source,this paper proposes a corresponding patent open source strategy at the three levels:enterprises,industries and the country,and formulates corresponding risk prevention and control measures,so as to take advantages of patent open source in creating patent ecology and promote the rapid development of related domestic industries.
