Risk and Regulation of Digital Aging in the Age of Algorithms

摘要 以泛在化、自动化和去中心化为核心特征的算法技术在深刻影响国家、社会与个人日常生产与生活方式的同时,也在老年群体面前横亘起一道新型的算法“数字鸿沟”。加快推进数字适老化进程是协同跨越算法“数字鸿沟”,顺利推进积极老龄化国家战略的时代面对与必然选择。在厘清数字适老化基本概念与重要意义的基础上,正视数字适老化过程中老年人群体面临的算法排斥、算法歧视与数字沉浸等算法风险,用以算治算的规控理念,健全与完善数字适老化双轨制立法体系,科学内置算法风险分类与识别法律代码,努力提升老年人群体的数字化素养,为构建不分年龄、普惠共享、代际和谐的积极老龄化数字社会提供法治保障。 Algorithmic technology with ubiquity,automation and decentralization as its core features has profoundly affected the daily production and lifestyle of the country,society and individuals,and has also created a new"digital divide"of algorithms in front of the aging population.Accelerating the digital aging process is an inevitable choice in the era of collaboratively crossing the"digital divide"of algorithms and smoothly advancing the national strategy of active aging.On the basis of clarifying the basic concepts and significance of digital aging,facing up to the algorithmic risks such as algorithm exclusion,algorithm discrimination and digital immersion faced by the elderly in the process of digital aging,with the concept of regulation and control based on calculation and calculation,improve and perfect the digital aging dual-track legislative system,scientifically built-in legal code for algorithm risk classification and identification,and strive to improve the digital literacy of the elderly group,provides legal guarantees for building an age-free,inclusive sharing,intergenerational harmonious and actively aging digital society.
