摘要
地方性产业政策对河北省经济转型升级发挥着重要的导向作用,但产业政策的制定实施过程也存在着程序不当、违背公平原则等风险,其背后一定程度上反映出法律控制的缺失。经济新常态下地方性产业政策也需向法治化转型,通过法治河北建设推进良法与善治的有效结合。建议以地方性产业政策立法加强规范程序建设、完善监督救济制度,将法治精神融入地方性产业政策,促进政府干预市场法治化,提升政府治理能力现代化水平。
Local industrial policy plays an important guiding role in economic transformation and upgrading of Hebei Province.However,there are risks in the process of formulating and implementing industrial policies,such as improper procedures and violation of the principle of fairness,which to some extent reflects the lack of legal control.Under the new normal of economy,local industrial policies also need to be transformed to the rule of law,and the effective combination of good law and good governance should be promoted through the construction of rule of law in Hebei.It is suggested that local industrial policy legislation should be used to promote the government’s intervention in the market rule of law,strengthen the construction of standardized procedures,improve the supervision and relief system,and integrate the spirit of rule of law into local industrial policies to enhance the modernization level of government governance ability.
