摘要伴随着大数据时代的到来,网络装备、皮肤、角色、电子账号、虚拟庄园、淘宝店铺、充值币卡等虚拟财产进入人们的生活。因虚拟财产引发的民事纠纷逐渐增多,主要包括因虚拟财产交易流转、继承、分割引发的物权纠纷、用户与网络运营商之间的服务合同合同纠纷和第三人侵犯虚拟财产权利人合法权益所引发的侵权纠纷等。在确定具体的民事法律关系时,需要明确虚拟财产的法律性质,进而对其进行准确的法律适用。学术界对于虚拟财产的性质界定没有统一的理论观点,司法实务中的主要争议是用户对虚拟财产享有的权利性质,不同的法院对虚拟财产的定性作出物权、债权、无形财产权、使用权和不予认定的判决,司法裁判不一致的现象大量产生,不利于保障虚拟财产合法所有权人的权益。因此,明确虚拟财产的法律属性采物权说并建构起虚拟财产民事保护的相关规则显得尤为重要。 With the advent of the era of big data,virtual properties such as network equipment,skin,role,electronic account,virtual manor,Taobao shop,top-up currency card have entered people's lives.Civil disputes caused by virtual property are gradually increasing,mainly including real right disputes caused by virtual property transaction and circulation,inheritance and division,service contract disputes between users and network operators,and infringement disputes caused by the infringement of the legitimate rights and interests of virtual property owners by third parties.In determining the specific civil legal relationship,it is necessary to clarify the legal nature of virtual property,and then apply it accurately.Academics in the nature of virtual property defines no unified theory viewpoint,and the main controversy in the judicial practice of virtual property rights is the user properties,different courts to qualitative property of virtual property rights,creditor's rights,intangible property right,the right to use and will not be decided that verdict,the production of large Numbers of the judicial referee inconsistent phenomenon,It is not conducive to protecting the rights and interests of the legal owners of virtual property.Therefore,it is particularly important to clarify the legal attribute of virtual property and establish relevant rules for the civil protection of virtual property.
