摘要
海上执法武力使用是涉及多方的多回合交互行为。有限的海上执法武力使用既是实现和平之海、安全之海的必要手段,也能有效维护国家主权、安全和权益。近年来,中国海警在管辖海域频繁遇到国外各类民用、商用及政府船舶。中国海警如何在复杂的国内外情势下有效使用武力,已成为亟须解决的问题。因此,“海洋命运共同体”理念的树立,海上行为结果无价值判断标准的确立,基于海域类型的海上执法武力使用制度的创设,以及海上执法武力使用能力的提升,都是中国海警海上执法武力使用的完善与推进路径。
The use of force in maritime law enforcement is an interaction involving multiple parties for multiple rounds.The limited use of force in maritime law enforcement is not only a necessary means to realize the peace and security of the sea,but also can effectively safeguard China’s national sovereignty,security and rights and interests.In recent years,the China Coast Guard has frequently encountered various foreign civil,commercial and government-owned vessels in the waters under its jurisdiction.How to effectively use force under complex domestic and international situations has become an urgent problem to be solved.Therefore,this article contends that the concept of“maritime community of shared destiny”,the criteria for judging the worthlessness of maritime behavior results,the creation of a system for the use of maritime law enforcement force based on the types of sea areas,and the path to improve the capability to use force in maritime law enforcement are the ways to improve and promote the use of force in maritime law enforcement by the China Coast Guard.
