摘要
阐明多层次社会保障体系的法理内涵,是社会保障法治化的关键要点。多层次社会保障体系的目标设定,蕴含四项法理要素,即人的要素、时空要素、公平要素和监督要素。根据实质性社会宪法观,上述要素的宪法规范基础,不能仅从宪法社会权条款获得理解,它包括四个综合维度:生存权与发展权的规范支撑、国家根本任务的目标指引、宪法平等原则的引申效力、宪法义务条款的整体约束。在宪法的立法实施语境下,多层次社会保障体系的立法塑造,在策略上需区分两种类型。创制型立法应以建立核心框架为要务;提升型立法应以体系化、融贯性为必要原则。就内容而言,应将多层次社会保障体系的法理要素,融入立法之中:基于尊重和保障人权的立法原则,推动社会保障分支型立法;基于普惠正义理念,促进社会保障立法的基础整合;基于公平原则,提升社会保障立法的层次完整性;立足于党和国家监督体系,推进社会保障专门性监督立法。
Clarifying the jurisprudence elements of multi-level social security system is the key point in the construction of the rule of law of social security.The goal of the multi-level social security system contains four jurisprudence elements,namely,the human element,the temporal and spatial element,the fairness element and the supervision element.According to the substantive social constitutional view,the constitutional basis of the above elements cannot be understood only from the social rights provisions,but includes four comprehensive dimensions:the normative support of the right to subsistence and the right to development,the goal guidance of the fundamental tasks of the state,the extended effect of the principle of constitutional equality,and the overall constraint of the constitutional obligation clause.In the context of the legislative implementation of the Constitution,the legislative shaping of the multi-level social security system needs to distinguish two types.Innovative legislation should focus on establishing core framework;Optimized legislation should be based on the principle of systematization and coherence.In terms of the content,the jurisprudence elements of multi-level social security system should be incorporated into legislation:promoting branch legislation based on the legislative principle of respecting and protecting human rights;promoting the integration of the foundations of social security legislation based on the concept of inclusive justice;enhancing the hierarchical integrity of social security legislation under the guidance of the principle of equity;promoting special supervision legislation based on the Party and State supervision system.
