大数据时代下互联网技术的丰富拓展,更多主体参与市场活动,主体间的市场力量强弱不同,数据垄断问题浮出水面。规制数字平台数据垄断问题,在传统行业相关市场垄断分析工具、支配地位认定、经营者集中审查方面存在挑战。探索数字平台数据垄断的规制出路,优化相关市场判定标准以及市场力量、革新市场份额计算方法、拓展经营者集中审查维度的规制策略,为数据行业的竞争博弈提供自由的市场环境。
With the rich expansion of Internet technology in the era of big data,more players participate in market activities,and the market power between players is different,so the problem of data monopoly appears.To regulate the data monopoly of digital platforms,there are challenges in the traditional industry-related market monopoly analysis tools,dominant position identification and operator concentration examination.To explore the regulatory outlet of digital platform data monopoly,optimize the relevant market judgment criteria and market power,innovate the calculation method of market share,and expand the regulatory strategy of operators'centralized review dimension,so as to provide a free market environment for the competition game in the data industry.
