摘要
随着全面从严治党战略的深入推进,党内法规数量急剧上升,党内法规学已然成为热门学科,党内法规解释则是该学科的重点研究内容。党内法规解释的功能主要有厘清含义、化解冲突、填补漏洞、维护权威、推动党内法规学发展等五个方面。党内法规解释应当坚持尊重文义、弘扬党章精神、坚持民主集中制、适应党的事业发展、符合宪法与党章规定等五项原则,这是在既有研究基础上再结合法律解释理论所得出的结论。党内法规解释的主体具有开放性,它们主要有制定主体、授权主体、多元主体与其他主体等。党内法规解释须遵循一定的程序,既定的解释程序需要进一步完善。党内法规的有权解释与党内法规具有同等效力,而无权解释则具有说理性效力。党内法规解释理论的发展,有助于党内法规的正确适用,从而为全面从严治党提供坚实的党内法规解释力量。
With the deepening of the strategy of administering the Party strictly in an all-round way,the number of inner-party laws and regulations has increased sharply,the study of inner-party laws and regulations has become a hot discipline,and the interpretation of inner-party laws and regulations is the key research content of this discipline.The functions of the interpretation of inner-party laws and regulations mainly include clarifying the meaning,resolving conflicts,filling loopholes,maintaining authority,and promoting the development of inner-party laws and regulations.The interpretation of inner-party laws and regulations should adhere to the five principles of respecting the meaning of the text,carrying forward the spirit of the Party Constitution,adhering to democratic centralism,adapting to the development of the Party's cause,and complying with the provisions of the Constitution and the Party Constitution.This is the conclusion drawn on the basis of existing research and in combination with the theory of legal interpretation.The main body of the interpretation of inner-party laws and regulations is open,including the main body of formulation,the main body of authorization,the main body of pluralism and other subjects.The interpretation of inner-party regulations must follow certain procedures,and the established interpretation procedures need to be further improved.The right to interpret the inner-party laws and regulations has the same effect as the inner-party laws and regulations,while the right to interpret has the reasoning effect.The development of the theory of interpretation of inner-party laws and regulations is conducive to the correct application of inner-party laws and regulations,thus providing a solid force for the interpretation of inner-party laws and regulations for the comprehensive and strict administration of the Party.
