摘要
自贸港(区)的法治建设是我国法治现代化进程中的新样态和新范式,海南自贸港及其自贸港法规属于其中的典范。《立法法》《海南自贸港法》授权海南“自由贸易港法规”的立法权,这是海南自贸港建设和持续优化法治化、国际化、便利化营商环境和公平统一高效的市场环境的根本要求,有助于推进形成以贸易投资自由化、便利化为重点的高效完备的自贸港法规体系。基于立法的基本原理,从形成和维护具有内在统一性的海南自贸港法规体系考虑,制定海南自贸港法规,应当坚持并遵循自由化与有效必要规制相结合、充分便利与简约高效相结合、借鉴移植为主自主创新为辅的技术性原则。
The Construction of the Free Trade Port(Zone)is a new model and paradigm in the process of modernising the rule of law in China.Hainan Free Trade Port and its regulations shall be seen as the model.The Legislation Law and the Hainan Free Trade Port Law authorise Hainan with the legislative power of“Free Trade Port Regulations”,which is the fundamental requirement for the Construction of Hainan’s Free Trade Port and the continuous optimisation of the rule of law,internationalisation and facilitation of the business environment and a fair,unified and efficient market environment.It will promote the formation of an efficient and complete system of Free Trade Port Regulations with a focus on trade and investment liberalisation and facilitation.Based on the basic principles of legislation,considering the formation and maintenance of the systematical inherent unity of Hainan Free Trade Port Regulations,the formulation of Hainan Free Trade Port Regulations should adhere to and follow the technical principles of combining liberalisation with effective and necessary regulations,combining full convenience with simplicity and efficiency,and focusing on reference and transplantation with independent innovation as the supplement.
