摘要
近年来,随着行政执法体制改革的重心由横向集中向纵向下放转变,各地政府均在探索下放行政执法权。目前已有近一半省份发布了行政执法权下放清单,不少市县区政府及其职能部门也在大规模下放行政执法权。当前轰轰烈烈的行政执法权下放活动隐藏着不容忽视的法治风险。下放依据不足、下放主体不适格、下放方式混乱、下放内容抵触上位法是行政执法权下放地方实践面临的共性问题。对此,全国人大常委会应适时修法为执法权下放提供充分的法律依据,国务院应强化行政执法权下放的顶层设计,对行政执法权下放的基本事项作出框架性规定,地方人大常委会则应加强对行政执法权下放决定的备案审查,确保行政执法权下放在法治轨道上运行。
In recent years,as the focus of the reform of the administrative system has shifted from horizontal concentration to vertical decentralization,local governments are exploring decentralization of administrative enforcement powersHalf of the provinces have issued a list of decentralization administrative enforcement powers,and a large number of cities,counties,districts,and their functional departments are also delegating administrative law enforcement powerThere are huge legal risks hidden behind the decentralizationThe legal basis for decentralization is insufficient,the subjects of decentralization are unqualified,the method of decentralization is chaotic,and some of the contents of decentralization are contradicting higher-level lawThese are all the common issues confronted in the local practice of decentralization of administrative enforcement powerTherefore,in order to ensure that the decentralization of administrative enforcement powers operates under the rule of law track,the Standing Committee of the National Peoples Congress should revise relevant laws in a timely manner to provide sufficient legal basis for the decentralization of law enforcement power,the State Council should strengthen the top-level design and make uniform provisions on the basic matters of the decentralization,and the Committees of Local Peoples Congresses should strengthen the review of the legitimacy of the decision on the decentralization of administrative enforcement powers.
