摘要
为防止警察自由裁量权的滥用,应当对它进行有效规制。关于警察自由裁量权,传统规制主要采用形式主义的法律路径,其在内容上涵盖扩大立法范围、强化执法监督、推进司法审查三个维度的内容。然而,此种依托规则而展开的形式主义法律规制路径,因存在难以克服的内生性困境,无法实现对警察自由裁量权的实质性约束。在理论上,警察自由裁量权是一种兼有规则与伦理双重属性的权力,即以规则为依据,以伦理为内核,这决定了对其规制不能偏重于形式主义法治路径,而应当以“德法合治”原则为基础确立法律与伦理相结合的规制原则。习近平法治思想中的“德法合治”原则为警察自由裁量权规制原则的确立指明了方向。之于警察自由裁量权,规制原则确立的路径应以人民主体性与公共性塑造警察权力的伦理基础,并以警察伦理作为警察自由裁量权的价值指引,最终借由内在的美德伦理与外在的制度伦理共同实现对警察自由裁量权的实质性规制。
To prevent the abuse of police discretion,effective regulation should be implemented.With regard to police discretion,the traditional regulation is mainly a formalism legal path,which covers three dimensions in content:expanding the scope of legislation,strengthening law enforcement supervision,and promoting judicial review.However,this kind of formalism legal regulation path based on rules cannot achieve substantive constraints on police discretion because of the inherent dilemma that is difficult to overcome.In theory,police discretion is a power that combines the dual attributes of rules and ethics,that is,based on rules and centered on ethics.This determines that its regulation cannot focus on the formalist path of rule of law,but should be based on the principle of"rule of virtue and law"to establish a regulatory principle that combines law and ethics.The principle of"rule of virtue and law"in Xi Jinping's thought on the rule of law has opened up imaginative space for the establishment of the principle of regulating police discretion.The path of establishing regulatory principles for police discretion should shape the ethical foundation of police power based on the subjectivity and publicity of the people,and use police ethics as the value guide of police discretion.Ultimately,substantive regulation of police discretion can be achieved through the combination of internal virtue ethics and external institutional ethics.
