摘要
在全球范围内,标准必要专利已成为汽车市场竞争的博弈焦点。由于FRAND原则、许可模式的模糊性,当前面临着关于许可层级、许可模式等标准必要专利许可纠纷难题。由于标准的必须实施性和专利的天然“垄断性”,导致标准必要专利权利人的话语权较强,极易产生“专利劫持”、一揽子许可等专利权滥用问题。相较于私法调整,从反垄断角度出发规制标准必要专利滥用行为更具有适用性,而标准必要专利垄断纠纷的认定思路应遵循我国《反垄断法》的基本分析框架,以确定相关市场,判断其是否具备市场支配地位,分析是否滥用知识产权,对市场竞争产生排除、限制影响等。
Globally,standard-essential patents have become the focus of competition in the automobile market.Due to the ambiguity of the FRAND principle and the licensing mode,we are currently facing many disputes over licensing tiers and licensing modes for standar d-essential patents.Due to the mandatory implementation of standards and the natural“monopoly”of patents,the right holders of patents have more right,which can easily lead to patent hold-up,blanket licensing and other patent abuse problems.Compared with the Judicial adjustments,it is more applicable to regulate the abuse of standard-essential patents from the angle of anti-monopoly,and the determination of disputes over monopoly of them should follow the basic analytical framework of China’s Antitrust Law,in order to determine the relevant market,judge whether it has a dominant position in the market,analyze whether it is an abuse of intellectual property rights,and exclude and restrict the impact of the competition in the market.
