摘要
将发表论文与学位授予相挂钩,一直是个饱受争议的话题。在“柴某杰案”中,法院虽然作出了确认违法的判决,但仍然采取的是程序主义的审查进路,以学术自治回避了论文发表作为学位授予标准的实体性问题。在高校权力下放的背景下,学院作为专业的科研管理机构可以成为制定论文发表标准的适格主体,但是将其作为学位授予标准有严格的适用条件,要体现学校的科研理念,接受学校的监督,在大学章程和学院学术权力清单中予以明确。此外,学院要严格遵循制定程序,让有利害关系的学生参与和发表意见,经过学校备案审查后方有效力。为了保障学生权利,司法应当具有能动性,构建正当性审查标准,以此来检验学院增设的论文发表要求作为学位授予标准的合法性和合理性。
It has been a controversial topic to link the publication of dissertation with the award of degree.In“Chai Moujie”case,although the court made a decision to confirm the violation of law,it still adopted a proceduralapproach to review the case,avoiding the substantive issue of dissertation publication as a degree awarding criterion with academic autonomy.In the background of decentralization of universities,the college,as a professional scientific research management institution,can become a qualifiedsubject to formulate the standards for the publication of articles,but there are strict conditions for its application as degree awarding standards,which reflect the university’s scientific research philosophy,accept the supervision of the university,and be clarified in the university constitution and the list of academic powers of the college.In addition,the college should strictly follow the formulation procedures to allow interested students to participate and express their opinions,which willbe valid after the university’s record review.In order to protect the rights of students,the judiciary should be active and have the ability to construct the justification review standard to test the legitimacy and rationality of the academic article publication requirement added by the college as a degree awarding standard.
