摘要
医疗损害赔偿责任构成必须突破责任构成上的“过错中心论”和损害救济上的“赔偿论”的思维框架,基于正义理论,通过对医患关系性质、医疗损害特征及医疗体制目标的全面考量,在正义理论视角下重构医疗损害赔偿责任中医患利益关系的理念基础,实现医疗损害赔偿责任分配中医患权益及社会公共利益的多元有效平衡。正义理论的探讨将对“医疗过错认定”的技术性操作转向对“医患利益”的实质性关注,为现行医疗损害赔偿责任规定的有效实施提供有益的指导,从而有利于缓解医患矛盾,推动和谐医患关系的构建。
The increasing crisis of"Medical ecology"leads to a new reflection on the liability of compensation for medical damage.The medical malpractice responsibility system must break through the thinking frame of"fault theory in the responsibility constitution"and"compensation theory in the damage relief",then take justice theory as the path to rebuild the concept basis of doctor-patient interest relationship in the medical damage liability system around the"justice"attribute of the system.Through the comprehensive consideration of the nature of doctor-patient relationship,the characteristics of medical damage and the goal of medical system,we could realize the multiple and effective balance of the rights and interests of TCM prescriptions,patients and social public interests in the allocation of medical damage liability.The discussion of justice theory will provide guidance for the future medical legislation and the effective implementation of the current system.The discussion of justice theory will turn the technical operation of"medical fault identification"to the substantive attention of"doctor-patient interests",and provide useful guidance for the effective implementation of the current medical damage system,so as to alleviate doctor-patient conflicts and promote the construction of harmonious doctor-patient relationship.
