摘要
房屋交易类型日益多元复杂,借名买房问题由来已久。因借名买房产生的法律纠纷多、案件争议大、社会关注度高、司法裁决难。从近年来中国裁判文书网借名买房案件裁判结果来看,房屋产权判决归出名人或归借名人的比例日趋偏高。学界、实务界观点纷呈,缺乏权威且有针对性的法律解读,适用不同的法律、法规及相关司法解释会导致同类案不同判。司法实践中判定借名买房的房屋归借名人所有虽具一定合理性,但潜在危机不可小觑,一是挑战民法典不动产物权登记生效的原则规定,二是增加治理房地产资源浪费及因房贷等诱发的社会群体事件难度。借名买房现象一时难以根除,亟需统一认识并依法合理规制,既需保护当事人合法权益,更应树立司法权威,将借名买房涉案房屋判处归出名人所有符合当下司法实践需求。
Housing transaction types become increasingly diversified and complex,and problems incurred by buying the house under other's name have existed for a long time.There are many legal disputes,big disputes,much social attention and difficult judicial decisions caused by buying a house under the name of a person.The adjudication results of the cases of borrowing names to buy houses in recent years reveal that the proportion of the adjudication of property rights to name lenders is increasing.There are various opinions in the academic and practical fields,and there is a lack of authoritative and well-targeted legal interpretation.The application of different laws,regulations and relevant judicial interpretations will lead to different judgments in similar cases.In judicial practice,it is reasonable to judge that the house bought under the name lenders,but the potential crisis should not be underestimated.On the one hand,it challenges the principle of effective registration of real estate in the Civil Law,and on the other hand,it increases the difficulty of treating the wasted real estate resources and eliminating social group crises caused by mortgage loans.It is difficult to instantly eradicate the phenomenon of buying houses under others'name,so it is urgent to reach unified understanding and take reasonable regulation according to law to protect the legitimate rights and interests of the parties and establish judicial authority.The adjudication of entrusting name lenders with the property right conforms to the current needs of judicial practice.
