摘要
为了维护海外利益安全、参加地区和国际安全合作及维护地区和世界和平等方面贡献力量,中国军事力量需要遂行联演、维和、反恐、救援及护航等海外军事行动。在“军事力量走出去”的大背景下,我国现行涉海外军事行动的刑事管辖规则却不足以适应这一国防工程的开展,在管辖对象范围、专门管辖及地域管辖等多个方面尚存缺陷,亟待改进。为了适应海外军事行动中的刑事管辖特点,有两种修缮方案可供参考:方案一是在现有规范性文件的基础上进行调整,保留《中央军委关于军队执行<中华人民共和国刑事诉讼法>若干问题的暂行规定》《办理军队和地方互涉刑事案件规定》这两个核心规则在海外军事行动领域的适用;方案二则是通过构建新的部门规范性文件或司法解释单独规定涉海外军事行动的刑事管辖问题。
In order to safeguard China's overseas interests and security,participate in regional and international security cooperation and make contributions to regional and world peace,China's military forces need to conduct overseas military services such as joint military exercises,and participate in the UN peacekeeping operations,as well as counter-terrorism,rescue and escort operations.Against the backdrop of China's"military defense's heading overseas"strategy,the current criminal jurisdiction rules concerning overseas military services are insufficient to adapt to the development of this defense project.There are still many deficiencies in the scope of jurisdictional objects,specialized jurisdiction,territorial jurisdiction and other aspects,which urgently needs to be resolved.In order to adapt to the characteristics of criminal jurisdiction over overseas military services,there are two options for reference.The first option is to make adjustments to existing normative documents,while retain the application of two core rules in the field of overseas military services,namely the Interim Provisions of the Central Military Commission on Certain Issues Concerning the People's Liberation Army's Implementation of the Criminal Procedure Law of the P.R.C and the Provisions on the Handling of Criminal Cases Involving both Servicemen and Local Civilians.The second option is to separately stipulate criminal jurisdiction related to overseas military services through the establishment of new departmental rules or judicial interpretations.
