摘要
虽然城市环境治理已取得一定成效,但农村环境治理仍不尽如人意,尤其是部分基层人民政府仍会以牺牲农村环境为代价来发展经济。面对因行政机关的乱作为或不作为而引发的环境公益损害,立法只明确承认了检察机关提起环境行政公益诉讼的原告资格,而忽视了其他主体的起诉权。实践中,即使村民委员会以环境公益受损为由提起环境行政公益诉讼,法院也主要适用行政诉讼方式解决纠纷。这在很大程度上造成了农村环境公益救济缺失、行政机关行为失范以及普通矛盾升级为环境群体性事件等问题。赋予村民委员会主体资格既符合司法实践的需求,又具理论合理性与现实可行性。同时,为防止滥诉,可在时间、空间、事实三个维度上限制村民委员会之诉权。
Although the urban environmental management has achieved some success,the rural environmental management is not as satisfactory as it should be,especially some of the grass-roots people's government still develop the economy at the expense of the rural environment.In the face of environmental public interest damage caused by the disorderly act or inaction of the administrative organ,the legislation only recognizes the plaintiff qualification of the procuratorial organ to bring environmental administrative public interest litigation,while ignoring the prosecution right of other subjects.In practice,even if the villagers'committee files an environmental administrative public interest litigation on the grounds of environmental public interest damage,the court mainly applies the administrative litigation method to resolve the dispute.To a large extent,this has resulted in the lack of public interest relief in rural areas,the misconduct of administrative organs,and the escalation of ordinary conflicts into environmental mass incidents.In fact,giving villagers'committees subjective status not only meets the needs of judicial practice,but also has theoretical reasonableness and practical feasibility.At the same time,in order to prevent abusive litigation,the villager committee's right of action can be restricted in three dimensions of time,space and fact.
