专有与垄断之间:新《体育法》下体育赛事视听信息权的规范进路 被引量:4

Between Proprietary Rights and Monopoly:The Path to Improvement of Audiovisual Information Rights for Sports Events under the New Sports Law

摘要 “涉中超联赛图片滥用市场支配地位纠纷案”是我国体育赛事图片市场反垄断第一案,该案集中反映了我国目前体育赛事现场图片采集及传播的市场乱象和法律争议。新《体育法》第52条第2款创设的体育赛事视听信息权,赋予体育赛事组织者等对体育赛事音视频信息的专有权利,为此类纠纷的解决提供了制度基础,同时也隐含了权利滥用和市场垄断的风险。在立法论视角下,该条款需要在权利客体上进一步细分,将体育赛事图片和体育赛事音视频分别予以规范;对权利内容进一步细化,分为固定权、复制权、发行权、信息网络传播权、展览权和放映权等子权利类型;引入权利限制制度,明确专有权利的期限以及合理使用的情形。在司法论视角下,应当将该专有权利作为判断相关市场和市场支配地位的重要考量因素,但在滥用行为的判断中对于专有权利应持中立态度。体育赛事图片市场的市场特性决定了反垄断法的介入应当保持谦抑性。 Dispute involving abuse of dominant market position in relation to Chinese Football Association Super League is the first antimonopoly case in China's sports event picture market The case reflects the market chaos and legal disputes in the picture collection and dissemination of sports events in China.Article 52,paragraph 2 of the new Sports Law creates the right of audiovisual information of sports events,which gives sports event organizers the exclusive right to the picture information of sports events,and provides an institutional basis for the settlement of such disputes,and also implies the huge risk of abuse of rights and market monopoly.From the perspective of legislation,this clause needs to be further subdivided in the object of rights,and to regulate the pictures of sports events and the audio and video of sports events respectively;the content of rights is further refined and divided into sub-rights such as fixed right,reproduction right,distribution right,information network transmission right,exhibition right and projection right;introduce right restriction system to clarify the duration of exclusive rights and the circumstances of fair use.From the perspective of judicial theory,the exclusive right should be taken as an important factor to judge the relevant market and market dominant position,but the exclusive right should be neutral in the judgment of the behavior of abuse.The market characteristics of the sports event picture market determine that the intervention of the anti-monopoly law should remain modest.
