区块链技术驱动下的UGC版权许可模式革新 被引量:3

The Innovation of UGC Copyright Licensing Mode Driven by Blockchain Technology

摘要 UGC创作和传播方式的转型,使版权权利“原子化”、版权公示缺失、作品可获得性受限的版权许可难题更为突出。传统的授权许可、集中许可和公共许可模式均无法化解UGC的版权许可困境,新的“屏蔽或变现”模式也面临忽视UGC创作者利益、方案过于单一等质疑。将区块链技术应用于“屏蔽或变现”模式中,不仅能在确权环节显著降低搜寻成本和实施成本,而且能在许可环节通过智能合约提供的标准化协议降低交易成本,促进UGC的高效创作和利用。为确保区块链技术助推下“屏蔽或变现”模式的运作顺畅,须通过明确平行创作规则、有效划定合理使用范围及强化UGC平台功能与责任,实现版权制度的衔接。 The transformation of the mode of creation and dissemination of UGC has made the copyright licensing problems of"atomization"of copyright rights,lack of copyright publicity and limited availability of works more prominent.The traditional licensing.centralized licensing and public licensing modes can not solve the copyright licensing dilemma of UGC,and the new"block or monetize"mode also faces doubts about ignoring the interests of UGC creators and oversimplified solutions.Applying blockchain technology to the new"block or monetize"mode can not only significantly reduce search costs and implementation costs in the confirmation link,but also reduce transaction costs through the standardized agreement provided by the smart contract in the licensing link.In order to ensure the smooth operation of the"block or monetize"mode with blockchain technology,it is necessary to clarify the rules of peer production,effectively delimit the scope of fair use,and strengthen the UGC platform functions and liability rules.
