摘要
在数字经济时代,算法是一种重要的生产工具。算法推荐技术被广泛应用于信息分发和媒体传播领域。算法推荐技术能有效解决全民创作时代的信息过载问题,但同时也引发了算法推荐机制下著作权侵权认定的难题。文章提出,使用算法推荐技术的网络服务提供者采用了一种新型的信息分发模式,但在实际应用中,由于算法推荐技术具有“伪中立性”和价值取向性,难以适用“技术中立原则”免责。文章认为,在判断标准上,应区分不同类型的侵权行为,并以主观过错为核心进行判定,明确“应知”的判断条件。由于互联网平台具有强大的信息管理能力,网络服务提供者理应对内容履行注意义务。
In the era of digital economy,algorithms are an important production tool.Algorithm recommendation technology can effectively solve the problem of information overload in the era of mass creation,and thus it is extensively applied in information distribution and media dissemination,but at the same time,it also raises the issue of copyright infringement determination.It's argued that network service providers have adopted a new information distribution model,but in practical applications,due to the“pseudo neutrality”and value orientation of algorithmic recommendation technology,the“technology neutrality”principle can not be applied to exempt from liability.The article believes that in terms of judgment criteria,different types of infringement should be distinguished,with subjective fault being the core criterion,clarifying the judgment criteria for“should know”.Due to the powerful information management capabilities of internet platforms,network service providers should fulfill their duty of care with regard to content.
