摘要
全国农村宅基地制度改革试点工作正在推进,海南结合本省情况对宅基地“三权”分置开展试点探索。三亚市试点探索了农村集体经济组织在宅基地退出、收回和整治基础上,为第三方设立宅基地经营权的“两权”分置模式,且允许设立物权性质宅基地经营权,该探索具有一定的创造性与突破性。文昌市试点既探索了农户基于宅基地使用权或农村集体经济组织基于农户暂时退出的宅基地,将债权性质宅基地利用权流转给第三方的“三权”分置模式,也探索了农村集体经济组织在农户永久退出宅基地的基础上将债权性质宅基地利用权流转给第三方的“两权”分置模式,该探索更具有全面性。三亚市与文昌市的试点方案均有进一步完善的空间。
The national rural homestead system reform pilot work is undertaking.Hainan Province has combined with it’s situation to carry out a pilot exploration of the seperation of“three rights”of homestead.The pilot project in Sanya city explored the separation of“two rights”model whereby rural collective economic set up the right to operate homestead for a third party on the basis of the withdrawal,recovery and remediation of the homestead,and allowed for the establishment of the right to operate homestead in the nature of property rights,which is a certain degree of creativity and a breakthrough in this exploration.The pilot in Wenchang city,Hainan Province,explored not only the separation of“three rights”model in which farmers on the basis of the right to use homestead or the rural collective economic organizations on the basis of the temporary withdrawal of farmers from the homestead,transfer the right to use homestead with the nature of creditors’right to a third party,but also the separation of“two rights”model in which rural collective economic organizations transfer the right to use homestead to a third party on the basis of the permanent withdrawal of farmers from the homestead,which is a more comprehensive approach to exploring the issue.The pilot programs in Sanya city and Wenchang city both have room for further improvement.
