摘要
RCEP联合委员会可以在缔约方大会框架下作出条约解释,它属于《维也纳条约法公约》第31条第3款(a)项下的嗣后协定。RCEP尚未明确规定联合解释对国际裁判机构的约束力,这可能导致国际裁判机构适用RCEP联合解释的不确定性。根据国际争端解决实践,RCEP联合解释也可能在程序方面和实体方面面临国际裁判机构的审查。值得注意的是,RCEP联合委员会通过的联合解释应避免超出条约解释范畴,防止RCEP联合解释成为争端解决的阻碍因素。为了充分发挥联合委员会解释RCEP条款的作用,RCEP联合委员会可以通过发布《RCEP联合解释程序规则》来细化联合解释规则,规则中应包括RCEP联合解释对国际裁判机构的约束力、RCEP联合解释的文件形式、RCEP联合解释对投资仲裁的溯及力以及RCEP联合解释对具体争议的处理期限等内容。为了维护国家利益和推进RCEP有效实施,中国应积极引领和参与RCEP联合委员会的条约解释工作,选择合适的条约解释议题,提供可以被RCEP其他成员广泛接受的方案,并推动RCEP联合解释的达成。
Treaty interpretation may be adopted by the meeting of the RCEP Joint Committee,which belongs to subsequent agreement in the Article 31(3)(a)of the Vienna Convention on the Law of Treaty.RCEP has not yet specified joint interpretation's binding force to international adjudicatory bodies,and it may lead to uncertainty about the application of the RCEP joint interpretation.Based on the practice of international dispute settlement,the RCEP joint interpretation may be reviewed by international adjudicatory bodies on procedural and substantive grounds.It's worth noting that RCEP Joint Committee should prevent the joint interpretation from becoming an obstacle to dispute settlement,and avoid going beyond the scope of treaty interpretation.In order to make full use of its treaty interpretation function,the RCEP Joint Committee can refine the rules of joint interpretation by issuing"RCEP Rules on Joint Interpretation Procedures",which should include the binding force of joint interpretation to international adjudicatory bodies,the document form of joint interpretation,the retroactivity of joint interpretation to investment arbitration,and time limit for the settlement of specific disputes.To safeguard national interests and promote the effective implementation of RCEP,China should actively lead and participate in the RCEP Joint Committee's work on treaty interpretation,select appropriate topics for treaty interpretation,provide a scheme widely accepted by other RCEP members,and promote consensus on the RCEP joint interpretation.
