摘要
从知识产权证券化风险的形成机理出发,分别从基础资产和交易流程两个方面探知其存在的风险,并在此基础上分析采用区块链技术介入知识产权证券化进行风险管理的路径:借助区块链技术的时间戳、哈希树根值以及基于区块链技术的数据库平台防范基础资产带来的法律风险;通过区块链特有的时间戳技术、数字签名和智能合约防范基础资产带来的收益风险;通过推进“双层结构+区块链”模式防范知识产权证券化的破产隔离风险;通过引入联盟链和智能合约技术防范交易过程中的信息不对称风险和信用风险。由此提出加快推进对区块链技术的迭代升级、加大对区块链技术人才的本土培养和引进力度,尤其是培养引进既懂知识产权证券化又懂区块链技术的“高精尖”人才,以及对监管机构、增信评级机构和各个参与机构的相关对策建议,为推进我国知识产权证券化工作提供思路。
Starting from the formation mechanism of intellectual property securitization risk,we explore the risks from the underlying assets and transaction process respectively,and analyze the risk management paths of using blockchain technology to intervene in intellectual property securitization.These paths include how to guard against the legal risks brought by the underlying assets with the help of blockchain technology's timestamps,hash tree root values,and the database platform based on blockchain technology,how to prevent the income risk of underlying assets through the the unique timestamp technology,digital signatures and smart contracts,how to prevent the bankruptcy isolation risk of intellectual property securitization by promoting the"dual layer structure plus blockchain"model,and how to prevent the information asymmetric risk and credit risk in the transaction process by introducing alliance chain and smart contract technology.As a result,it is proposed to accelerate the iterative upgrading of blockchain technology,increase the local training and introduction of blockchain technology talents,especially the training and introduction of highprecision talents with knowledge of both intellectual property securitization and blockchain technology,as well as other relevant countermeasures and suggestions for regulators,credit-enhancing and rating agencies and various participating institutions,so as to provide ideas for promoting intellectual property securitization in China.
