摘要
基因科技的发展给人类生活带来诸多益处,但同时基因技术的不当运用也可能造成基因信息泄露、克隆人、基因武器等风险,亦即基因安全风险。基因安全风险是指不确定性对基因安全的影响,是基因利益受到内外部威胁的可能性和导致的严重后果。为了更加全面地了解基因安全风险,并在此基础上更好地规制基因安全风险,研究基因安全风险的类型与规制原则是非常有必要的。具体而言,基因安全风险的类型分为国家基因风险、民族基因风险、社会基因风险和个人基因风险。基因安全风险规制的原则主要有风险预防原则、比例原则与公众参与原则。稳定的规制原则能够指导我们应对不同类型、法律条文不曾涉及,甚至从未出现过的新风险。
The development of genetic technology has brought many benefits to human life,but at the same time,the improper use of genetic technology may also cause risks such as gene information leakage,human cloning,and genetic weapons,which is also known as genetic safety risks.Gene safety risk refers to the impact of uncertainty on gene safety,which is the possibility and serious consequences of internal and external threats to gene interests.In order to gain a more comprehensive understanding of genetic safety risks and better regulate them on this basis,it is necessary to study the types and regulatory principles of genetic safety risks.Specifically,the types of genetic safety risks are divided into national genetic risks,ethnic genetic risks,social genetic risks,and individual genetic risks.The principles of regulating genetic safety risks mainly include risk prevention,proportionality,and public participation.Stable regulatory principles can guide us in dealing with different types of new risks that have not been addressed or even appeared in legal provisions.
