摘要
国家公园是保护自然资源的重要方式,已得到世界各国的普遍认可。全面推进国家公园体制建设已成为当前中国生态文明建设的一项重要任务。文中梳理和总结美国、澳大利亚、加拿大、日本和德国5个国家在国家公园管理模式、法律体系构建、资金保障机制方面的经验,提出对中国国家公园体制建设的3个建议:1)采用“垂直型”的政府主导管理机制;2)建立以国家公园法为上位法,地方管理条例为补充的法律约束体系;3)加快构建和完善国家公园多元化资金保障机制。
National park has been widely recognized by countries around the world as an important way to protect natural resources.Comprehensively promoting the construction of national park systems has become an important task in current ecological civilization development.The paper reviews and summarizes the experience of 5 countries,i.e.,the United States,Australia,Canada,Japan,and Germany,in national park management mode,legal system development and financial guarantee mechanism,and proposes 3 suggestions on China s national park system development,including:1)adopting a“vertical”government-led management mechanism;2)establishing the legal system with national park law as the superior law and regional management regulations as the supplements;and 3)accelerating the establishment and improvement of a diversified funding guarantee mechanism for national parks.
