摘要
电竞酒店作为互联网技术与旅店业融合的新兴产物,存在传统旅店业说、互联网上网服务营业场所说、折中说等三种定性争议。目前,监管部门在对电竞酒店的设立审批、监管力量、监管方式和监管效果等方面存在难点。放任电竞酒店野蛮生长会导致引发酒店行业的恶性竞争、危害未成年人身心健康发展、不利于成年在校大学生的健康发展和滋生相关违法犯罪行为等现实危害。对此,电竞酒店应落实住宿安全主体责任、信息网络安全主体责任、治安管理责任和未成年人保护责任。对电竞酒店实现有效监管,应该在顶层设计、整合检查力量和方式、建立电子化监管机制和引导行业自律等方面下功夫。
As an emerging product of the integration of Internet technology and the hotel industry,there are three qualitative disputes:the traditional hotel industry,the Internet service business place,and the compromise theory.At present,there are dfficulties in the regulatory authorities in approving the establishment of e-sports hotels,and the force,the method and the effect of regulatory.Failure to manage will lead to vicious competition in the hotel industry,endanger the physical and mental health development of minors and adult college students,and breed related illegal and criminal acts.In this regard,e-sports hotels should implement the main responsibility for accommodation security,information network security,public security management,and protection of minors.To achieve effective supervision of e-sports hotels,it is necessary to design at the top level,integrate inspection forces and methods,establish an electronic supervision mechanism,and guide industry self-discipline.
