互联网搭售行为违法性认定的困局及纾解

摘要 互联网搭售行为可谓屡见不鲜。但是,互联网经济具有的免费模式、双边市场、网络效应及跨界竞争等特征致使互联网搭售行为形式多样、表征复杂,行为违法性认定也陷入困境。实践考察发现,当前认定互联网搭售行为违法性尚存产品独立性认定标准不明、行为强制性难以判定、竞争效果评估存在障碍等困局。鉴于此,提出以下建议:其一,产品独立性认定应摈弃传统单一标准的认定模式,构建以消费者需求标准为核心的复合标准认定模式;其二,行为强制效果判定应弱化对主观心理的考量,侧重对客观事实进行判断;其三,竞争效果评估应当从法益保护视角出发,对行为产生的正负效果进行多维度的结构化衡量。 Tying in the Internet is not uncommon,but the characteristics of the Internet economy,such as the free model,two-sided market,network effect,and cross-border competition,make Internet tying behaviors diverse and complex,and the determination of illegality of acts is also in trouble.Practical investigation finds that there are still difficulties in the determination of the illegality of Internet tying,such as unclear standards for determining product independence,difficulty in determining the compulsion of behavior,and obstacles to the evaluation of competition effects.In view of this,the following suggestions are put forward:first,the identification of product independence should abandon the traditional single standard identification model and build a composite standard identification model with consumer demand standard as the core;Second,the determination of the coercive effect of behavior should weaken the consideration of subjective psychology and focus on the judgment of objective facts.Third,the evaluation of competition effect should be based on the perspective of legal interest protection,and the positive and negative effects produced by the behavior should be measured in a multi-dimensional and structured manner.
