摘要
法治既是一定社会的物质生产发展的产物,又是人类迈入文明社会的重要标志。虽然古今中外对法治的理解和阐述众说纷纭,但是法治作为一种规则之治是基本共识。以历史唯物主义的基本立场和观点,从法治的起源和本质入手,发现法治有阶级性、共同性、工具性的特点,法治的基本要素是:(一)法治意识;(二)法律制度;(三)法治行为。
The rule of law is not only a product of the development of material production in a certain society but also an important symbol of mankind’s entry into civilized society.Although there are different understandings and interpretations of the rule of law at all times and in all countries,the rule of law as a rule of regulation is a basic consensus.Based on the basic stance and viewpoints of historical materialism and starting from the origin and essence of the rule of law,this article finds that the rule of law is characterized by its hierarchical,communitarian and instrumental nature,and the basic elements of which is the awareness,system,and action of the rule of law.
