摘要
虚拟货币具有去中心化、匿名化、跨境性等特点,推动互联网技术创新发展的同时,也给犯罪分子跨境转移涉案资金提供了便利,给犯罪侦查工作带来挑战。虚拟货币犯罪侦查工作中存在线索研判效率低、涉案资金处置难等诸多困境,建设和完善虚拟货币侦查平台既是“科技兴警”战略下智慧公安建设的必然要求,也是犯罪侦查的现实所需。公安机关应当结合实战建设包括线索研判功能、资金处置功能、溯源审计功能在内的虚拟货币侦查平台,并辅以完善法律制度、实行警企合作、加强跨境警务合作、持续优化侦查平台功能等措施,不断提升虚拟货币侦查平台的时代性和实战性。
Virtual currency has the characteristics of decentralization,anonymity and cross-border,which promotes the innovation and development of Internet technology,but also provides convenience for criminals to transfer funds across the border,and brings challenges to criminal investigation.There are many difficulties in the investigation of virtual currency crimes,such as low efficiency of investigation and judgment of clues and difficult disposal of funds involved.The construction and improvement of virtual currency investigation platform is not only the inevitable requirement of the intelligent public security under the strategy of“Technology Boosts the Police”,but also the realistic need of criminal investigation.Public security organs should build virtual currency investigation platforms with clue research and judgment functions,fund disposal functions,traceability and audit functions in combination with measures such as improving the legal system,implementing police enterprise cooperation,strengthening cross-border police cooperation,and continuously optimizing the investigation platform functions,so as to continuously improve the nature of time and practicability of the virtual currency investigation platform.
