摘要
从《威斯特伐利亚和约》到《联合国宪章》的现代国际法实践表明,国际法原则具有极其重要的地位和作用。运用法律生成说,探讨国际法的理念经由原则转化为调整国际法主体间关系的规则及其体系的内在生成逻辑,有助于理解不同于国内法但同样具有法的形成和发展特点的国际法。这对于我国走向国际舞台中央,参与和引领全球治理体制改革,以及更好地把握国际规则的制定规律,具有重要的理论与实际意义。从“实然”和“应然”视角看待原则在国际法实践中的地位,《联合国宪章》“实然”原则对于当代国际法秩序具有基础性地位和作用。中国继倡导“和平共处五项原则”之后,在世界百年未有之大变局之际进一步提出“推动构建人类命运共同体”主张,具有内涵深刻的国际法理念。作为整体,应发挥其“应然”原则的引领和建制作用,并通过相应规则的制定,使之成为新型全球治理和解决国际争端的规范。
It has been demonstrated by the practices of modern international law from the Peace of Westphalia to the Charter of United Nations that the principles of international law have the critical important status and roles. By application of the legal embryology to explore the inherent logic of the ideas of international law to be the rules through the linkage of principles as the regulatory system of international relations, it is significant from the perspectives of theory and practice to understand the international law distinguished from the domestic law, but with the similar character of formation and development of law in general, to hold the indispensable approach of the rule-making of international law for China's participation and leading of the reform of the global governance while moving towards the center of the international arena. Taking the viewpoints of the status of principle in the practice of international laws “as it is” and “as it ought to be”, the principle “as it is” under the Charter of United Nations has the fundamental status and roles. China insists in “the Five Principles of Peaceful Coexistence” while putting forward a solution “to promote the building of a Human Community with a Shared Future” in the time of an unknown change in century. It embodies the profound ideas of international law, and should be institutionalized as whole as the principle “as it ought to be” to have the roles of leadership and construction in order to be made as the new rules for the global governance and the settlement of international disputes.
