摘要
在经济全球化背景下,有效预防企业犯罪是各国面临的一大难题。建立企业合规契合宽严相济的刑事政策、恢复性司法以及预防犯罪的刑罚目的,具有正当性根据。事前有效的企业合规可以阻却主观罪过,具有出罪价值,但效力只及于企业,不及于个人。合规出罪的途径主要是不起诉制度,应增设一种新的特殊裁量不起诉。事前或事后的企业合规反映涉罪企业再犯可能性较低,可以通过定罪免刑、从轻或减轻处罚以及缓刑制度从宽量刑。
In the context of economic globalization,how to effectively prevent the corporate crimes is a major issue facing all countries.Corporate compliance is in line with the lenient-and-severe criminal policy,restorative justice and the purpose of crime prevention,so it has a legitimate basis.Effective pre-corporate-compliance can prevent subjective errors,having the value of decriminalization for enterprises only,not for individuals.The decriminalization for corporate compliance mainly depends on the non-prosecution system.It's necessary to have a new special discretionary non-prosecution.Pre-compliance and post-compliance reflect that it's less possible for enterprises to be involved in crimes;therefore,corporates should be sentenced leniently by exempting from punishment,giving lighter or mitigated punishment and applying probation.
