摘要
较之于相对完备的城市建设规划制度,乡村建设规划制度起步晚、实施难度大。在农村住房建设纠纷中,实际用地情况与现时规划是否符合、规划调整有无引发权利减损是常见的法律争议点。这些问题的出现与乡村建设规划制度在概念阐释、程序建构、补偿制度等方面不够完善相关,并将对村民土地财产权利产生影响。在构建此类案件的裁判规则时,既要重视村庄规划的法定效力,又要结合地方历史政策、村庄规划的现时状态等情况进行综合评价。对于因规划变更造成财产损失的村民,需进一步明确补偿机制。
In comparison to the well-established urban construction planning system,the rural construction planning system started late and faces implementation challenges.In rural areas,the functions of village planning has not received sufficient attention.In disputes related to rural housing construction,common points of contention in judicial proceedings include whether the actual land use aligns with current planning,whether the planning adjustments have caused a reduction in rights.The emergence of these issues is associated with deficiencies in the conceptual interpretation,procedural construction,and compensation system of the rural construction planning system,which can impact the property rights of villagers.When constructing adjudication rules for such cases,it is essential to emphasize the legal effectiveness of village planning while conducting a comprehensive assessment considering local historical policies,the current status of rural planning,and other relevant factors.Further clarification of compensation mechanisms is required for villagers experiencing property losses due to planning changes.
