摘要
耕地用途管制法制优化是在不改变耕地农用的基础上的耕地用途管制的法制优化,即耕地农作物转换种植管制的法制优化。梳理耕地用途管制的措施,探讨大食物观背景下耕地用途管制的法制优化方向及难点,重点阐述大食物观与既有耕地用途管制措施的耦合、既有耕地用途管制与大食物观的匹配度分析以及耕地用途管制优化的法治路径。结果表明:我国农产品需求结构发生变化已经成为不可逆转的趋势,而现有的耕地用途管制措施在一定程度上已经不能适应我国农产品需求结构的变化所带来的农产品供给结构的变化,因此需要对耕地用途管制进行法制优化,推动农产品供给侧结构性改革进一步深化发展,以改善耕地利用不平衡、不充分的现状,使耕地资源利用满足人们食物需求结构的变化。
The optimization of legal system of cultivated land use discussed in this paper is on the basis of not changing the agricultural use of land,that is,the legal optimization for regulating the conversion of crops on cultivated land.This paper reviewed the measures of cultivated land use regulation,and discussed the direction and difficulties of legal optimization of cultivated land use regulation adopting an all-encompassing approach to food.This paper focused on the coupling of this approach and the existing cultivated land use regulating measures,the matching analysis between the two,and the legal path for the optimization.The paper finds that the change of the demand structure of agricultural products in China has become an irreversible trend,and the existing regulating measures can no longer adapt to the changes in the supply structure of agricultural products brought about by this change to a certain extent.Therefore,it is necessary to optimize the legal system of cultivated land use regulation and further advance the supply-side structural reform of agricultural products in order to improve the current situation of unbalanced and insufficient use of cultivated land,and to enable cultivated land resources to meet the changes in people's food demand.
