摘要
在各项区域协调发展战略实施与贯彻过程中,授权特定机构或地方进行改革与试验性立法已成为我国重要的立法制度。2023年《立法法》修改虽然增设了区域协同立法,但本质上仍是各地方独立制定地方性法规在本行政区域内实施的工作机制,无法突破各区域内部地方立法主体权限不足以及区域内部核心利益分配乏力之现实困境。将授权立法制度引入区域协同立法,应当采取区域各方立法主体主动提出授权申请、精准授权与批量清单式授权相结合、授权立法主体审查批准的方式,以及确立以区域内部主要被授权立法主体为核心,其余被授权立法主体为补充的授权格局,同时通过被授权立法主体扩容、地方立法变通以及授权立法监督强化,建构各区域协同发展法,形成授权区域协同立法新模式。
In the process of implementing and carrying out various regional coordinated development strategies,authorizing specific institutions or locations to undertake reform and experimental legislation has emerged as a crucial legislative system in our nation.Despite the introduction of a regional collaborative legislation system in the 2023 Legislative Law revision,it is still essentially a mechanism for localities to independently formulate local laws and regulations that are to be implemented in their own administrative regions.This approach fails to address the practical predicament of insufficient authority of local legislative bodies in each region and the inadequate distribution of core interests within the area.Integrating the authorization legislation system into regional collaborative legislation requires regional legislative bodies to proactively submit authorization applications,combine precise authorization with batch list authorization,and empower legislative bodies with reviewing and approving.This establishes an authorization pattern where the main authorized legislative bodies in the region as the core,complemented by the other authorized legislative bodies.Concurrently,expanding authorized legislative subjects,adapting local legislation,and enhancing supervision of authorized legislation contribute to the construction of a regional legal system guided by the coordinated development laws of various regions,thereby establishing a new mode of authorized regional collaborative legislation.
