新文科背景下法学教育的教学整体观 被引量:3

The Holistic Perspective of Legal Education in the Context of the New Humanities

摘要 国家建设“新文科”旨在回应社会新需求,更大限度地推进学科间、专业间的交叉融合,并立足于新时代促进文科发展。法学作为文科的重要组成部分,其传统教育教学整体观有所缺失,表现在价值目标定位不清、不注重学科之间的衔接、提倡专业系统分工精细化等多方面。在新文科教育背景下,法学教育必须打破传统部门法之间的知识壁垒,以教学整体观为指导,务实倡导学生自主学习与法学相关的社科人文知识,改革第一课堂对法律知识教育的方法,重视法律技能教育,严格落实第二课堂,重视法律职业伦理的培育。 The construction of the"New Humanities"by the state aims to respond to new social demands,promote greater interdisciplinary and inter-professional integration,and promote the development of humanities in the new era.As an integral part of the humanities,legal education has deficiencies in its traditional holistic view of education and teaching,manifested in unclear value goal positioning,lack of emphasis on interdisciplinarity,and advocacy for fine division of professional systems.In the context of the New Humanities education,legal education must break down the knowledge barriers between traditional departmental laws and be guided by a holistic view of teaching.It should pragmatically advocate for students'autonomous learning of social science and humanities knowledge related to law,reform the methods of legal knowledge education in the first classroom,emphasize legal skills education,rigorously implement extracurricular activities,and prioritize the cultivation of legal professional ethics.
